Tampering with Evidence-Not Guilty
After stopping our client for speeding, the DPS Trooper believed he smelled the odor of green marijuana in our client's vehicle. The Trooper then searched and located a baggie that he said had the corner torn off but contained "particles" of marijuana along with some Swisher Sweets. Believing our client must have eaten the marijuana, the Trooper approached our client and had him open his mouth. After seeing what he said was marijuana stuck in our client's teeth and smelling marijuana on his breath, he arrested him for tampering with evidence, a third degree felony. After less than 30 minutes of deliberations, a jury found our client Not Guilty.
